These Terms of Service ("Terms") govern your use of the Kino mobile application (the "App") and any related services provided by Petar Perkovski ("we", "our", or "us"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you are at least 13 years of age (or 16 years in the European Economic Area), have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the App on behalf of a minor under your care, you accept these Terms on their behalf and take responsibility for their compliance.
2. Description of the Service
Kino is a passive reassurance application that monitors your daily activity (step count from Apple HealthKit) and sends status updates to a set of trusted contacts that you designate ("Trusted Circle"). The purpose of the service is to provide non-emergency peace of mind — not to diagnose, treat, monitor, or manage any medical condition.
Kino is not a medical device, emergency alert system, or safety-of-life service. It must not be relied upon in any situation where the safety of a person may be at risk. If you or someone you know is in an emergency, call the relevant emergency services immediately.
3. Account Registration
The App uses anonymous authentication — no email address or password is required. When you first open the App, an anonymous account is automatically created and linked to your device. You are responsible for maintaining access to the device. We are not liable for any loss resulting from your loss of device access.
4. Subscriptions and Payments
4.1 Free Tier
Kino is free to download and includes core reassurance functionality at no charge.
4.2 Kino Pro
Kino Pro is an optional paid subscription that unlocks expanded features. It is available in the following plans, processed and billed exclusively through the Apple App Store:
- Weekly — billed weekly, recurring.
- Yearly — billed annually, recurring.
- Lifetime — one-time purchase, no ongoing billing.
4.3 Billing & Renewal
Recurring subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment is charged to the Apple ID account on file. You can manage and cancel subscriptions at any time through the App Store: Settings → [your name] → Subscriptions → Kino.
4.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policies. We do not issue refunds directly. For accidental purchases or other billing issues, please contact Apple Support at reportaproblem.apple.com.
4.5 Price Changes
We reserve the right to change subscription prices at any time. If we change the price of a recurring subscription, we will notify you in advance. Continued use after the price change takes effect constitutes acceptance of the new price.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Misrepresent your identity or impersonate any person.
- Add contacts to your Trusted Circle without their knowledge or consent.
- Use the App to harass, stalk, or surveil any individual.
- Attempt to reverse-engineer, decompile, or tamper with the App or its backend services.
- Circumvent or interfere with any security features of the App.
- Use the App in any way that could damage, disable, or impair our systems.
6. Health Data
The App requests access to your step count from Apple HealthKit. You grant this permission voluntarily. You can revoke access at any time via the Apple Health app. Your raw step count is never uploaded to our servers — only a derived status is transmitted. Kino is not a medical device and the information it provides must not be used for medical decision-making.
7. Trusted Contacts
By adding a person to your Trusted Circle, you represent that:
- You have obtained the explicit consent of that person to receive reassurance updates from you.
- You are not using Kino to track or monitor any person without their knowledge.
We reserve the right to suspend accounts that we reasonably believe are being used to surveil individuals without their consent.
8. Intellectual Property
The App, including its design, code, branding, and content, is owned by us and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the App without our express written consent.
9. Privacy
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
10. Third-Party Services
The App integrates third-party services including Apple HealthKit, Back4App (Parse), and RevenueCat. Use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
In particular, we do not warrant that reassurance notifications will be delivered in a timely manner or that the activity evaluation will always accurately reflect your wellbeing. Kino is not a substitute for direct communication or emergency services.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising from the use of the App shall not exceed the amount you paid for Kino Pro in the twelve months preceding the claim (or £10 / €10 if you have not made any paid purchase).
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the App; (b) your breach of these Terms; or (c) your infringement of any third-party rights.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms or if we discontinue the service. You may stop using the App at any time and delete your account from Settings → Data → Delete All Data.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, via an in-app notice. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
16. Governing Law & Disputes
These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of France. As France is an EU member state, you also benefit from mandatory EU consumer protection laws, including your right to bring claims before the courts of your country of habitual residence.
